Ericsson Device Analytics Terms of Use

ANY PERSON OR ENTITY ("User") DOWNLOADING AND USING Ericsson Ericsson Device Analytics AGREES TO AND IS BOUND BY THE FOLLOWING TERMS OF SERVICE AND PRIVACY POLICY (the "Agreement"):

This Agreement is a legal agreement between the User and Ericsson AB ("Ericsson"), a company established under the law of Sweden, for using the application Ericsson Ericsson Device Analytics. By downloading and using the Ericsson Ericsson Device Analytics application (the "Application") you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, your sole recourse is to not use the application. Before you use the Application you should read each of the chapters of these Terms of Use and print or save a local copy for your records.

The User expressly confirms that the User is aware, understands and agrees that;

• the Application is experimental in nature, is still in concept development phase;

• the Application is made available "as is" with no warranty of any kind and the User uses the content at its own risk.

• Ericsson may at any time modify or discontinue availability of the Application without any notification and with no liability in relation to any user of the Application;

• User is solely responsible for (if relevant) any access and communication charges (e.g. Data traffic charges) that might be incurred using the Application;

• Ericsson shall be entitled to store and handle User's particulars (sw "personuppgifter")

1 Privacy
The User acknowledges and agrees that the Application, when downloaded and installed, will connect to Ericsson's servers, and that Ericsson's servers will, through the Application, gain access to information about the User and the User's device, which may consist of personal data (sw: "personuppgifter") and mobile traffic data (app statistics, location, network performance) and use such information to (i) provide the Ericsson Ericsson Device Analytics service, (ii) research aiming at improving Ericsson's current and future products and services. Any processing of the User's personal data will be in compliance with applicable law. Ericsson confirms that it will not access the content stored on the User's devices for other purposes than described above. Ericsson will make every reasonable effort to ensure that the information will be maintained in a secure environment. Ericsson may share aggregate (not personally identifiable) information with its business partners or other third parties. Ericsson will not, however, knowingly disclose personal data to third parties unless required to do so in order to comply with any valid legal process, such as a search warrant, subpoena, statute, court order, or if necessary or appropriate to address an unlawful or harmful activity. The user identity is treated anonymously using pseudo anonymization, meaning the user identifier is hashed and therefore not possible to retrieve. 2 User information
The Application requires information about the user's identity, geographical location in combination with time and how other applications installed on the user's phone are used. The information will start to be delivered when you download and install the Application. Information about the user's geographical location is obtained from your mobile phone when it is turned on, based on the phone's internal information and/or GPS functionality, including details about your phone model, manufacturer and serial number. The information is time stamped. Information about usage of Ericsson Ericsson Device Analytics and other applications installed on your phone are obtained from the application in question when it is used. Consumption means running the app, installing and uninstalling the app. Your data is stored until further notice, or until you actively request it. All your data is stored with an anonymous identifier. You can, at any time, stop being located and stop providing any other personal data by uninstalling the application.

3 3rd party functions
When accessing third party functions available in Ericsson Ericsson Device Analytics, you agree to be bound by the terms and conditions from those third parties.

4 Mobile Data Charges and Restrictions
The Application makes use of the data connection of your mobile device to send and receive data to and from our servers. Your network operator's normal data and other rates and fees will apply. You should check with your network operator to find out what plans are available and how much they cost. In addition, downloading, installing, or using certain mobile services may be prohibited or restricted by your network operator or in your country and not all mobile services may work with all carriers or devices. Therefore, you should check with your network operator to find out if the mobile services are available for your subscription and in your country, and what restrictions, if any, may be applicable to your use of such mobile services.

5 Disclaimer of Warranty
SUBJECT TO MANDATORY LAW, THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF CONDITION, UNINTERRUPTED USE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS OR ANY OTHER PROPRIETARY RIGHTS OF A THIRD PARTY.

6 Limitation of liability
SUBJECT TO MANDATORY LAW, THE USER ASSUMES ANY AND ALL RESPONSIBILITIES AND RISKS RELATING TO THE USE OF THE APPLICATION. THE USER'S SOLE REMEDY AGAINST ERICSSON RELATING TO THE APPLICATION IS TO STOP USING THE APPLICATION. IN NO EVENT SHALL ERICSSON AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL AND OR CONSEQUENTIAL DAMAGES AND OR LOSS WHATSOEVER (INCLUDING BUT NOT LIMITED TO MONETARY LOSSES OR LOSS OF DATA) ARISING FROM ANY KIND OF USE OF THE APPLICATION.

7 Governing law
This Agreement shall be governed by and construed in accordance with the laws of Sweden.
